The General Conference of the United Nations Educational, Scientific and Cultural Organization hereinafter referred to as UNESCO, meeting in Paris, from 29 September to 17 October 2003, at its 32nd session,
Referring to existing international human rights instruments, in particular to the Universal Declaration on Human Rights of 1948, the International Covenant on Economic, Social and Cultural Rights of 1966, and the International Covenant on Civil and Political Rights of 1966,
Considering the importance of the intangible cultural heritage as a mainspring of cultural diversity and a guarantee of sustainable development, as underscored in the UNESCO Recommendation on the Safeguarding of Traditional Culture and Folklore of 1989, in the UNESCO Universal Declaration on Cultural Diversity of 2001, and in the Istanbul Declaration of 2002 adopted by the Third Round Table of Ministers of Culture,
Considering the deep-seated interdependence between the intangible cultural heritage and the tangible cultural and natural heritage,
Recognizing that the processes of globalization and social transformation, alongside the conditions they create for renewed dialogue among communities, also give rise, as does the phenomenon of intolerance, to grave threats of deterioration, disappearance and destruction of the intangible cultural heritage, in particular owing to a lack of resources for safeguarding such heritage,
Being aware of the universal will and the common concern to safeguard the intangible cultural heritage of humanity,
Recognizing that communities, in particular indigenous communities, groups and, in some cases, individuals, play an important role in the production, safeguarding, maintenance and re-creation of the intangible cultural heritage, thus helping to enrich cultural diversity and human creativity,
Noting the far-reaching impact of the activities of UNESCO in establishing normative instruments for the protection of the cultural heritage, in particular the Convention for the Protection of the World Cultural and Natural Heritage of 1972,
Noting further that no binding multilateral instrument as yet exists for the safeguarding of the intangible cultural heritage,
Considering that existing international agreements, recommendations and resolutions concerning the cultural and natural heritage need to be effectively enriched and supplemented by means of new provisions relating to the intangible cultural heritage,
Considering the need to build greater awareness, especially among the younger generations, of the importance of the intangible cultural heritage and of its safeguarding,
Considering that the international community should contribute, together with the States Parties to this Convention, to the safeguarding of such heritage in a spirit of cooperation and mutual assistance,
Recalling UNESCO’s programmes relating to the intangible cultural heritage, in particular the Proclamation of Masterpieces of the Oral and Intangible Heritage of Humanity,
Considering the invaluable role of the intangible cultural heritage as a factor in bringing human beings closer together and ensuring exchange and understanding among them,
Adopts this Convention on this seventeenth day of October 2003.

  I. General provisionsArticle 1 – Purposes of the ConventionThe purposes of this Convention are:
(a) to safeguard the intangible cultural heritage; (b) to ensure respect for the intangible cultural heritage of the communities, groups and individuals concerned; (c) to raise awareness at the local, national and international levels of the importance of the intangible cultural heritage, and of ensuring mutual appreciation thereof; (d) to provide for international cooperation and assistance.
Article 2 – DefinitionsFor the purposes of this Convention,
1. The “intangible cultural heritage” means the practices, representations, expressions, knowledge, skills – as well as the instruments, objects, artefacts and cultural spaces associated therewith – that communities, groups and, in some cases, individuals recognize as part of their cultural heritage. This intangible cultural heritage, transmitted from generation to generation, is constantly recreated by communities and groups in response to their environment, their interaction with nature and their history, and provides them with a sense of identity and continuity, thus promoting respect for cultural diversity and human creativity. For the purposes of this Convention, consideration will be given solely to such intangible cultural heritage as is compatible with existing international human rights instruments, as well as with the requirements of mutual respect among communities, groups and individuals, and of sustainable development.
2. The “intangible cultural heritage”, as defined in paragraph 1 above, is manifested inter alia in the following domains: (a) oral traditions and expressions, including language as a vehicle of the intangible cultural heritage; (b) performing arts; (c) social practices, rituals and festive events; (d) knowledge and practices concerning nature and the universe; (e) traditional craftsmanship.
3. “Safeguarding” means measures aimed at ensuring the viability of the intangible cultural heritage, including the identification, documentation, research, preservation, protection, promotion, enhancement, transmission, particularly through formal and non-formal education, as well as the revitalization of the various aspects of such heritage.
4. “States Parties” means States which are bound by this Convention and among which this Convention is in force.
5. This Convention applies mutatis mutandis to the territories referred to in Article 33 which become Parties to this Convention in accordance with the conditions set out in that Article. To that extent the expression “States Parties” also refers to such territories.
Article 3 – Relationship to other international instrumentsNothing in this Convention may be interpreted as:
(a) altering the status or diminishing the level of protection under the 1972 Convention concerning the Protection of the World Cultural and Natural Heritage of World Heritage properties with which an item of the intangible cultural heritage is directly associated; or (b) affecting the rights and obligations of States Parties deriving from any international instrument relating to intellectual property rights or to the use of biological and ecological resources to which they are parties.

总则  第1 条: 本公约的宗旨

  本公约的宗旨如下:

  (a) 保护非物质文化遗产;

  (b) 尊重有关群体、团体和个人的非物质文化遗产;

  (c) 在地方、国家和国际一级提高对非物质文化遗产及其相互鉴赏的重要性的意识;

  (d) 开展国际合作及提供国际援助。

  第2 条: 定义

  在本公约中,

  1. “非物质文化遗产”指被各群体、团体、有时为个人视为其文化遗产的各种实践、表演、表现形式、知识和技能及其有关的工具、实物、工艺品和文化场所。各个群体和团体随着其所处环境、与自然界的相互关系和历史条件的变化不断使这种代代相传的非物质文化遗产得到创新,同时使他们自己具有一种认同感和历史感,从而促进了文化多样性和人类的创造力。在本公约中,只考虑符合现有的国际人权文件,各群体、团体和个人之间相互尊重的需要和顺应可持续发展的非物质文化遗产。

  2. 按上述第1 段的定义,“非物质文化遗产”包括以下方面:

  (a) 口头传说和表述,包括作为非物质文化遗产媒介的语言;

  (b) 表演艺术;

  (c) 社会风俗、礼仪、节庆;

  (d) 有关自然界和宇宙的知识和实践;

  (e) 传统的手工艺技能。

  3. “保护”指采取措施,确保非物质文化遗产的生命力,包括这种遗产各个方面的确认、立档、研究、保存、保护、宣传、弘扬、承传(主要通过正规和非正规教育)和振兴。

  4. “缔约国”指受本公约约束且本公约在它们之间也通用的国家。

  5. 根据本条款所述之条件,本公约经必要修改对成为其缔约方之第33 条所指的领土也适用。从这个意义上说,“缔约国”亦指这些领土。

  第3 条: 与其它国际文书的关系

  本公约的任何条款均不得解释为:

  (a) 有损被宣布为1972 年《保护世界文化和自然遗产公约》的世界遗产、直接涉及非物质文化遗产内容的财产的地位或降低其受保护的程度;或

  (b) 影响缔约国从其作为缔约方的任何有关知识产权或使用生物和生态资源的国际文书所获得的权利和所负有的义务。
II. Organs of the ConventionArticle 4 – General Assembly of States Parties1. A General Assembly of the States Parties is hereby established, hereinafter referred to as “the General Assembly”. The General Assembly is the sovereign body of this Convention.
2. The General Assembly shall meet in ordinary session every two years. It may meet in extraordinary session if it so decides or at the request either of the Intergovernmental Committee for the Safeguarding of the Intangible Cultural Heritage or of at least one-third of the States Parties.
3. The General Assembly shall adopt its own Rules of Procedure.
Article 5 – Intergovernmental Committee for the Safeguarding of the Intangible Cultural Heritage1. An Intergovernmental Committee for the Safeguarding of the Intangible Cultural Heritage, hereinafter referred to as “the Committee”, is hereby established within UNESCO. It shall be composed of representatives of 18 States Parties, elected by the States Parties meeting in General Assembly, once this Convention enters into force in accordance with Article 34.
2. The number of States Members of the Committee shall be increased to 24 once the number of the States Parties to the Convention reaches 50.
Article 6 – Election and terms of office of States Members of the Committee1. The election of States Members of the Committee shall obey the principles of equitable geographical representation and rotation.
2. States Members of the Committee shall be elected for a term of four years by States Parties to the Convention meeting in General Assembly.
3. However, the term of office of half of the States Members of the Committee elected at the first election is limited to two years. These States shall be chosen by lot at the first election.
4. Every two years, the General Assembly shall renew half of the States Members of the Committee.
5. It shall also elect as many States Members of the Committee as required to fill vacancies.
6. A State Member of the Committee may not be elected for two consecutive terms.
7. States Members of the Committee shall choose as their representatives persons who are qualified in the various fields of the intangible cultural heritage.
Article 7 – Functions of the CommitteeWithout prejudice to other prerogatives granted to it by this Convention, the functions of the Committee shall be to:
(a) promote the objectives of the Convention, and to encourage and monitor the implementation thereof; (b) provide guidance on best practices and make recommendations on measures for the safeguarding of the intangible cultural heritage; (c) prepare and submit to the General Assembly for approval a draft plan for the use of the resources of the Fund, in accordance with Article 25; (d) seek means of increasing its resources, and to take the necessary measures to this end, in accordance with Article 25; (e) prepare and submit to the General Assembly for approval operational directives for the implementation of this Convention; (f) examine, in accordance with Article 29, the reports submitted by States Parties, and to summarize them for the General Assembly; (g) examine requests submitted by States Parties, and to decide thereon, in accordance with objective selection criteria to be established by the Committee and approved by the General Assembly for: (i) inscription on the lists and proposals mentioned under Articles 16, 17 and 18; (ii) the granting of international assistance in accordance with Article 22.
Article 8 – Working methods of the Committee1. The Committee shall be answerable to the General Assembly. It shall report to it on all its activities and decisions.
2. The Committee shall adopt its own Rules of Procedure by a two-thirds majority of its Members.
3. The Committee may establish, on a temporary basis, whatever ad hoc consultative bodies it deems necessary to carry out its task.
4. The Committee may invite to its meetings any public or private bodies, as well as private persons, with recognized competence in the various fields of the intangible cultural heritage, in order to consult them on specific matters.
Article 9 – Accreditation of advisory organizations1. The Committee shall propose to the General Assembly the accreditation of non-governmental organizations with recognized competence in the field of the intangible cultural heritage to act in an advisory capacity to the Committee.
2. The Committee shall also propose to the General Assembly the criteria for and modalities of such accreditation.
Article 10 – The Secretariat1. The Committee shall be assisted by the UNESCO Secretariat.
2. The Secretariat shall prepare the documentation of the General Assembly and of the Committee, as well as the draft agenda of their meetings, and shall ensure the implementation of their decisions.

公约的有关机关  第4 条: 缔约国大会

  1. 兹建立缔约国大会,下称“大会”。大会为本公约的最高权力机关。

  2. 大会每两年举行一次常会。如若它作出此类决定或政府间保护非物质文化遗产委员会或至少三分之一的缔约国提出要求,可举行特别会议。

  3. 大会应通过自己的议事规则。

  第5 条: 政府间保护非物质文化遗产委员会

  1. 兹在教科文组织内设立政府间保护非物质文化遗产委员会,下称“委员会”。在本公约依照第34 条的规定生效之后,委员会由参加大会之缔约国选出的18 个缔约国的代表组成。

  2. 在本公约缔约国的数目达到50 个之后,委员会委员国的数目将增至24 个。

  第6 条: 委员会委员国的选举和任期

  1. 委员会委员国的选举应符合公平的地理分配和轮换原则。

  2. 委员会委员国由本公约缔约国大会选出,任期四年。

  3. 但第一次选举当选的半数委员会委员国的任期为两年。这些国家在第一次选举后抽签指定。

  4. 大会每两年对半数委员会委员国进行换届。

  5. 大会还应选出填补空缺席位所需的委员会委员国。

  6. 委员会委员国不得连选连任两届。

  7. 委员会委员国应选派在非物质文化遗产各领域有造诣的人士为其代表。

  第7 条: 委员会的职能

  在不妨碍本公约赋予委员会的其它职权的情况下,其职能如下:

  (a) 宣传公约的目标,鼓励并监督其实施情况;

  (b) 就好的做法和保护非物质文化遗产的措施提出建议;

  (c) 按照第25 条的规定,拟订利用基金资金的计划并提交大会批准;

  (d) 按照第25 条的规定,努力寻求增加其资金的方式方法,并为此采取必要的措施;

  (e) 拟订实施公约的业务指南并提交大会批准;

  (f) 根据第29 条的规定,审议缔约国的报告并将报告综述提交大会;

  (g) 根据委员会制定的、大会批准的客观遴选标准,审议缔约国提出的申请并就以下事项作出决定:

  (i) 列入第16、第17 和第18 条述及的名录和提名;

  (ii) 按照第22 条的规定提供国际援助。

  第8 条: 委员会的工作方法

  1. 委员会对大会负责。它向大会报告自己的所有活动和决定。

  2. 委员会以其委员的三分之二多数通过自己的议事规则。

  3. 委员会可临时设立它认为对执行其任务所需的咨询机构。

  4. 委员会可邀请在非物质文化遗产各领域确有专长的任何公营或私营机构以及任何自然人参加会议,就任何具体的问题向其请教。

  第9 条: 咨询组织的认证

  1. 委员会应就由在非物质文化遗产领域确有专长的非政府组织做认证向大会提出建

  议。这类组织的职能是向委员会提供咨询意见。

  2. 委员会还应向大会就此认证的标准和方式提出建议。

  第10 条: 秘书处

  1. 委员会由教科文组织秘书处协助。

  2. 秘书处起草大会和委员会文件及其会议的议程草案和确保其决定的执行。

III. Safeguarding of the intangible cultural heritage at the national levelArticle 11 – Role of States PartiesEach State Party shall:
(a) take the necessary measures to ensure the safeguarding of the intangible cultural heritage present in its territory; (b) among the safeguarding measures referred to in Article 2, paragraph 3, identify and define the various elements of the intangible cultural heritage present in its territory, with the participation of communities, groups and relevant non-governmental organizations.
Article 12 – Inventories1. To ensure identification with a view to safeguarding, each State Party shall draw up, in a manner geared to its own situation, one or more inventories of the intangible cultural heritage present in its territory. These inventories shall be regularly updated.
2. When each State Party periodically submits its report to the Committee, in accordance with Article 29, it shall provide relevant information on such inventories.
Article 13 – Other measures for safeguardingTo ensure the safeguarding, development and promotion of the intangible cultural heritage present in its territory, each State Party shall endeavour to:
(a) adopt a general policy aimed at promoting the function of the intangible cultural heritage in society, and at integrating the safeguarding of such heritage into planning programmes; (b) designate or establish one or more competent bodies for the safeguarding of the intangible cultural heritage present in its territory; (c) foster scientific, technical and artistic studies, as well as research methodologies, with a view to effective safeguarding of the intangible cultural heritage, in particular the intangible cultural heritage in danger; (d) adopt appropriate legal, technical, administrative and financial measures aimed at: (i) fostering the creation or strengthening of institutions for training in the management of the intangible cultural heritage and the transmission of such heritage through forums and spaces intended for the performance or expression thereof; (ii) ensuring access to the intangible cultural heritage while respecting customary practices governing access to specific aspects of such heritage; (iii) establishing documentation institutions for the intangible cultural heritage and facilitating access to them.
Article 14 – Education, awareness-raising and capacity-buildingEach State Party shall endeavour, by all appropriate means, to:
(a) ensure recognition of, respect for, and enhancement of the intangible cultural heritage in society, in particular through: (i) educational, awareness-raising and information programmes, aimed at the general public, in particular young people; (ii) specific educational and training programmes within the communities and groups concerned; (iii) capacity-building activities for the safeguarding of the intangible cultural heritage, in particular management and scientific research; and (iv)non-formal means of transmitting knowledge; (b) keep the public informed of the dangers threatening such heritage, and of the activities carried out in pursuance of this Convention; (c) promote education for the protection of natural spaces and places of memory whose existence is necessary for expressing the intangible cultural heritage.
Article 15 – Participation of communities, groups and individualsWithin the framework of its safeguarding activities of the intangible cultural heritage, each State Party shall endeavour to ensure the widest possible participation of communities, groups and, where appropriate, individuals that create, maintain and transmit such heritage, and to involve them actively in its management.
IV. Safeguarding of the intangible cultural heritage at the international levelArticle 16 – Representative List of the Intangible Cultural Heritage of Humanity1. In order to ensure better visibility of the intangible cultural heritage and awareness of its significance, and to encourage dialogue which respects cultural diversity, the Committee, upon the proposal of the States Parties concerned, shall establish, keep up to date and publish a Representative List of the Intangible Cultural Heritage of Humanity.
2. The Committee shall draw up and submit to the General Assembly for approval the criteria for the establishment, updating and publication of this Representative List.
Article 17 – List of Intangible Cultural Heritage in Need of Urgent Safeguarding1. With a view to taking appropriate safeguarding measures, the Committee shall establish, keep up to date and publish a List of Intangible Cultural Heritage in Need of Urgent Safeguarding, and shall inscribe such heritage on the List at the request of the State Party concerned.
2. The Committee shall draw up and submit to the General Assembly for approval the criteria for the establishment, updating and publication of this List.
3. In cases of extreme urgency – the objective criteria of which shall be approved by the General Assembly upon the proposal of the Committee – the Committee may inscribe an item of the heritage concerned on the List mentioned in paragraph 1, in consultation with the State Party concerned.
Article 18 – Programmes, projects and activities for the safeguarding of the intangible cultural heritage1. On the basis of proposals submitted by States Parties, and in accordance with criteria to be defined by the Committee and approved by the General Assembly, the Committee shall periodically select and promote national, subregional and regional programmes, projects and activities for the safeguarding of the heritage which it considers best reflect the principles and objectives of this Convention, taking into account the special needs of developing countries.
2. To this end, it shall receive, examine and approve requests for international assistance from States Parties for the preparation of such proposals.
3. The Committee shall accompany the implementation of such projects, programmes and activities by disseminating best practices using means to be determined by it.

在国家一级保护非物质文化遗产  第11 条: 缔约国的作用

  各缔约国应该:

  (a) 采取必要措施确保其领土上的非物质文化遗产受到保护;

  第12 条: 清单

  (b) 指定或建立一个或数个主管保护其领土上的非物质文化遗产的机构;

  (c) 鼓励开展有效保护非物质文化遗产,特别是濒危非物质文化遗产的科学、技术和艺术研究以及方法研究;

  (d) 采取适当的法律、技术、行政和财政措施,以便:

  (i) 促进建立或加强培训管理非物质文化遗产的机构以及通过为这种遗产提供活动和表现的场所和空间,促进这种遗产的承传;

  (ii) 确保对非物质文化遗产的享用,同时对享用这种遗产的特殊方面的习俗做法予以尊重;

  (iii) 建立非物质文化遗产文献机构并创造条件促进对它的利用。

  第14 条: 教育、宣传和能力培养

  各缔约国应竭力采取种种必要的手段,以便:

  (a) 使非物质文化遗产在社会中得到确认、尊重和弘扬,主要通过:

  (i) 向公众,尤其是向青年进行宣传和传播信息的教育计划;

  (ii) 有关群体和团体的具体的教育和培训计划;

  (iii) 保护非物质文化遗产,尤其是管理和科研方面的能力培养活动;

  (iv) 非正规的知识传播手段。

  (b) 不断向公众宣传对这种遗产造成的威胁以及根据本公约所开展的活动;

  (c) 促进保护表现非物质文化遗产所需的自然场所和纪念地点的教育。

  第15 条: 群体、团体和个人的参与

  缔约国在开展保护非物质文化遗产活动时,应努力确保创造、保养和承传这种遗产的群体、团体,有时是个人的最大限度的参与,并吸收他们积极地参与有关的管理。
  第16 条: 人类非物质文化遗产代表作名录

  1. 为了扩大非物质文化遗产的影响,提高对其重要意义的认识和从尊重文化多样性的角度促进对话,委员会应根据有关缔约国的提名编辑、更新和公布人类非物质文化遗产代表作名录。

  2. 委员会拟订有关编辑、更新和公布此代表作名录的标准并提交大会批准。

  第17 条: 急需保护的非物质文化遗产名录

  1. 为了采取适当的保护措施,委员会编辑、更新和公布急需保护的非物质文化遗产名录,并根据有关缔约国的要求将此类遗产列入该名录。

  2. 委员会拟订有关编辑、更新和公布此名录的标准并提交大会批准。

  3. 委员会在极其紧急的情况(其具体标准由大会根据委员会的建议加以批准)下,可与有关缔约国协商将有关的遗产列入第1 段所提之名录。

  第18 条: 保护非物质文化遗产的计划、项目和活动

  1. 在缔约国提名的基础上,委员会根据其制定的、大会批准的标准,兼顾发展中国家的特殊需要,定期遴选并宣传其认为最能体现本公约原则和目标的国家、分地区或地区保护非物质文化遗产的计划、项目和活动。

  2. 为此,委员会接受、审议和批准缔约国提交的关于要求国际援助拟订此类提名的申请。

  3. 委员会按照它确定的方式,配合这些计划、项目和活动的实施,随时推广有关经验。

V. International cooperation and assistanceArticle 19 – Cooperation1. For the purposes of this Convention, international cooperation includes, inter alia, the exchange of information and experience, joint initiatives, and the establishment of a mechanism of assistance to States Parties in their efforts to safeguard the intangible cultural heritage.
2. Without prejudice to the provisions of their national legislation and customary law and practices, the States Parties recognize that the safeguarding of intangible cultural heritage is of general interest to humanity, and to that end undertake to cooperate at the bilateral, subregional, regional and international levels.
Article 20 – Purposes of international assistanceInternational assistance may be granted for the following purposes:
(a) the safeguarding of the heritage inscribed on the List of Intangible Cultural Heritage in Need of Urgent Safeguarding; (b) the preparation of inventories in the sense of Articles 11 and 12; (c) support for programmes, projects and activities carried out at the national, subregional and regional levels aimed at the safeguarding of the intangible cultural heritage; (d) any other purpose the Committee may deem necessary.
Article 21 – Forms of international assistanceThe assistance granted by the Committee to a State Party shall be governed by the operational directives foreseen in Article 7 and by the agreement referred to in Article 24, and may take the following forms:
(a) studies concerning various aspects of safeguarding; (b) the provision of experts and practitioners; (c) the training of all necessary staff; (d) the elaboration of standard-setting and other measures; (e) the creation and operation of infrastructures; (f) the supply of equipment and know-how; (g) other forms of financial and technical assistance, including, where appropriate, the granting of low-interest loans and donations.
Article 22 – Conditions governing international assistance1. The Committee shall establish the procedure for examining requests for international assistance, and shall specify what information shall be included in the requests, such as the measures envisaged and the interventions required, together with an assessment of their cost.
2. In emergencies, requests for assistance shall be examined by the Committee as a matter of priority.
3. In order to reach a decision, the Committee shall undertake such studies and consultations as it deems necessary.
Article 23 – Requests for international assistance1. Each State Party may submit to the Committee a request for international assistance for the safeguarding of the intangible cultural heritage present in its territory.
2. Such a request may also be jointly submitted by two or more States Parties.
3. The request shall include the information stipulated in Article 22, paragraph 1, together with the necessary documentation.
Article 24 – Role of beneficiary States Parties1. In conformity with the provisions of this Convention, the international assistance granted shall be regulated by means of an agreement between the beneficiary State Party and the Committee.
2. As a general rule, the beneficiary State Party shall, within the limits of its resources, share the cost of the safeguarding measures for which international assistance is provided.
3. The beneficiary State Party shall submit to the Committee a report on the use made of the assistance provided for the safeguarding of the intangible cultural heritage.

国际合作与援助  第19 条: 合作

  第22 条: 国际援助的条件

  1. 委员会确定审议国际援助申请的程序和具体规定申请的内容,包括打算采取的措施、必需开展的工作及预计的费用。

  3. 委员会在作出决定之前,应进行其认为必要的研究和咨询。

VI. Intangible Cultural Heritage FundArticle 25 – Nature and resources of the Fund1. A “Fund for the Safeguarding of the Intangible Cultural Heritage”, hereinafter referred to as “the Fund”, is hereby established.
2. The Fund shall consist of funds-in-trust established in accordance with the Financial Regulations of UNESCO.
3. The resources of the Fund shall consist of: (a) contributions made by States Parties; (b) funds appropriated for this purpose by the General Conference of UNESCO; (c) contributions, gifts or bequests which may be made by: (i) other States; (ii) organizations and programmes of the United Nations system, particularly the United Nations Development Programme, as well as other international organizations; (iii) public or private bodies or individuals; (d) any interest due on the resources of the Fund; (e) funds raised through collections, and receipts from events organized for the benefit of the Fund; (f) any other resources authorized by the Fund’s regulations, to be drawn up by the Committee.
4. The use of resources by the Committee shall be decided on the basis of guidelines laid down by the General Assembly.
5. The Committee may accept contributions and other forms of assistance for general and specific purposes relating to specific projects, provided that those projects have been approved by the Committee.
6. No political, economic or other conditions which are incompatible with the objectives of this Convention may be attached to contributions made to the Fund.
Article 26 – Contributions of States Parties to the Fund1. Without prejudice to any supplementary voluntary contribution, the States Parties to this Convention undertake to pay into the Fund, at least every two years, a contribution, the amount of which, in the form of a uniform percentage applicable to all States, shall be determined by the General Assembly. This decision of the General Assembly shall be taken by a majority of the States Parties present and voting which have not made the declaration referred to in paragraph 2 of this Article. In no case shall the contribution of the State Party exceed 1% of its contribution to the regular budget of UNESCO.
2. However, each State referred to in Article 32 or in Article 33 of this Convention may declare, at the time of the deposit of its instruments of ratification, acceptance, approval or accession, that it shall not be bound by the provisions of paragraph 1 of this Article.
3. A State Party to this Convention which has made the declaration referred to in paragraph 2 of this Article shall endeavour to withdraw the said declaration by notifying the Director-General of UNESCO. However, the withdrawal of the declaration shall not take effect in regard to the contribution due by the State until the date on which the subsequent session of the General Assembly opens.
4. In order to enable the Committee to plan its operations effectively, the contributions of States Parties to this Convention which have made the declaration referred to in paragraph 2 of this Article shall be paid on a regular basis, at least every two years, and should be as close as possible to the contributions they would have owed if they had been bound by the provisions of paragraph 1 of this Article.
5. Any State Party to this Convention which is in arrears with the payment of its compulsory or voluntary contribution for the current year and the calendar year immediately preceding it shall not be eligible as a Member of the Committee; this provision shall not apply to the first election. The term of office of any such State which is already a Member of the Committee shall come to an end at the time of the elections provided for in Article 6 of this Convention.
Article 27 – Voluntary supplementary contributions to the FundStates Parties wishing to provide voluntary contributions in addition to those foreseen under Article 26 shall inform the Committee, as soon as possible, so as to enable it to plan its operations accordingly.
Article 28 – International fund-raising campaignsThe States Parties shall, insofar as is possible, lend their support to international fund-raising campaigns organized for the benefit of the Fund under the auspices of UNESCO.
VII. ReportsArticle 29 – Reports by the States PartiesThe States Parties shall submit to the Committee, observing the forms and periodicity to be defined by the Committee, reports on the legislative, regulatory and other measures taken for the implementation of this Convention.
Article 30 – Reports by the Committee1. On the basis of its activities and the reports by States Parties referred to in Article 29, the Committee shall submit a report to the General Assembly at each of its sessions.
2. The report shall be brought to the attention of the General Conference of UNESCO.

非物质文化遗产基金  第25 条: 基金的性质和资金来源

  1. 兹建立一项“保护非物质文化遗产基金”,下称“基金”。

  2. 根据教科文组织《财务条例》的规定,此项基金为信托基金。

  3. 基金的资金来源包括:

  (a) 缔约国的纳款;

  (b) 教科文组织大会为此所拨的资金;

  (c) 以下各方可能提供的捐款、赠款或遗赠:

  (i) 其它国家;

  (ii) 联合国系统各组织和各署(特别是联合国开发计划署)以及其它国际组织;

  (iii) 公营或私营机构或个人;

  (d) 基金的资金所得的利息;

  (e) 为本基金募集的资金和开展活动之所得;

  (f) 委员会制定的基金条例所许可的所有其它资金。

  4. 委员会对资金的使用视大会的方针来决定。

  5. 委员会可接受用于某些项目的一般或特定目的的捐款及其它形式的援助,只要这些项目已获委员会的批准。

  6. 对基金的捐款不得附带任何与本公约所追求之目标不相符的政治、经济或其它条件。

  第26 条: 缔约国对基金的纳款

  1. 在不妨碍任何自愿补充捐款的情况下,本公约缔约国至少每两年向基金纳一次款, 其金额由大会根据适用于所有国家的统一的纳款额百分比加以确定。缔约国大会关于此问题的决定由出席会议并参加表决,但未作本条第2 段中所述声明的缔约国的多数通过。在任何情况下,此纳款都不得超过缔约国对教科文组织正常预算纳款的百分之一。

  2. 但是,本公约第32 条或第33 条中所指的任何国家均可在交存批准书、接受书、赞同书或加入书时声明不受本条第1 段规定的约束。

  3. 已作本条第2 段所述声明的本公约缔约国应努力通知联合国教育、科学及文化组织总干事收回所作声明。但是,收回声明之举不得影响该国在紧接着的下一届大会开幕之日前应缴的纳款。

  4. 为使委员会能够有效地规划其工作,已作本条第2 段所述声明的本公约缔约国至少应每两年定期纳一次款,纳款额应尽可能接近它们按本条第1 段规定应交的数额。

  5. 凡拖欠当年和前一日历年的义务纳款或自愿捐款的本公约缔约国不能当选为委员会委员,但此项规定不适用于第一次选举。已当选为委员会委员的缔约国的任期应在本公约第6 条规定的选举之时终止。

  第27 条: 基金的自愿补充捐款

  除了第26 条所规定的纳款,希望提供自愿捐款的缔约国应及时通知委员会以使其能对相应的活动作出规划。

  第28 条: 国际筹资运动

  缔约国应尽力支持在教科文组织领导下为该基金发起的国际筹资运动。
报告  第29 条: 缔约国的报告

  缔约国应按照委员会确定的方式和周期向其报告它们为实施本公约而通过的法律、规章条例或采取的其它措施的情况。

  第30 条: 委员会的报告

  1. 委员会应在其开展的活动和第29 条提及的缔约国报告的基础上,向每届大会提交报告。

  2. 该报告应提交教科文组织大会。
VIII. Transitional clauseArticle 31 – Relationship to the Proclamation of Masterpieces of the Oral and Intangible Heritage of Humanity1. The Committee shall incorporate in the Representative List of the Intangible Cultural Heritage of Humanity the items proclaimed “Masterpieces of the Oral and Intangible Heritage of Humanity” before the entry into force of this Convention.
2. The incorporation of these items in the Representative List of the Intangible Cultural Heritage of Humanity shall in no way prejudge the criteria for future inscriptions decided upon in accordance with Article 16, paragraph 2.
3. No further Proclamation will be made after the entry into force of this Convention.

过渡条款  第31 条: 与宣布人类口述和非物质遗产代表作的关系

  1. 委员会应把在本公约生效前宣布为“人类口述和非物质遗产代表作”的遗产纳入人类非物质文化遗产代表作名录。

  2. 把这些遗产纳入人类非物质文化遗产代表作名录绝不是预设按第16 条第2 段将确定的今后列入遗产的标准。

  IX. Final clausesArticle 32 – Ratification, acceptance or approval1.This Convention shall be subject to ratification, acceptance or approval by States Members of UNESCO in accordance with their respective constitutional procedures.
2. The instruments of ratification, acceptance or approval shall be deposited with the Director-General of UNESCO.
Article 33 – Accession1. This Convention shall be open to accession by all States not Members of UNESCO that are invited by the General Conference of UNESCO to accede to it.
2. This Convention shall also be open to accession by territories which enjoy full internal self-government recognized as such by the United Nations, but have not attained full independence in accordance with General Assembly resolution 1514 (XV), and which have competence over the matters governed by this Convention, including the competence to enter into treaties in respect of such matters.
3. The instrument of accession shall be deposited with the Director-General of UNESCO.
Article 34 – Entry into forceThis Convention shall enter into force three months after the date of the deposit of the thirtieth instrument of ratification, acceptance, approval or accession, but only with respect to those States that have deposited their respective instruments of ratification, acceptance, approval, or accession on or before that date. It shall enter into force with respect to any other State Party three months after the deposit of its instrument of ratification, acceptance, approval or accession.
Article 35 – Federal or non-unitary constitutional systemsThe following provisions shall apply to States Parties which have a federal or non-unitary constitutional system:
(a) with regard to the provisions of this Convention, the implementation of which comes under the legal jurisdiction of the federal or central legislative power, the obligations of the federal or central government shall be the same as for those States Parties which are not federal States; (b) with regard to the provisions of this Convention, the implementation of which comes under the jurisdiction of individual constituent States, countries, provinces or cantons which are not obliged by the constitutional system of the federation to take legislative measures, the federal government shall inform the competent authorities of such States, countries, provinces or cantons of the said provisions, with its recommendation for their adoption.
Article 36 – Denunciation1. Each State Party may denounce this Convention.
2. The denunciation shall be notified by an instrument in writing, deposited with the Director-General of UNESCO.
3. The denunciation shall take effect twelve months after the receipt of the instrument of denunciation. It shall in no way affect the financial obligations of the denouncing State Party until the date on which the withdrawal takes effect.
Article 37 – Depositary functionsThe Director-General of UNESCO, as the Depositary of this Convention, shall inform the States Members of the Organization, the States not Members of the Organization referred to in Article 33, as well as the United Nations, of the deposit of all the instruments of ratification, acceptance, approval or accession provided for in Articles 32 and 33, and of the denunciations provided for in Article 36.
Article 38 – Amendments1. A State Party may, by written communication addressed to the Director-General, propose amendments to this Convention. The Director-General shall circulate such communication to all States Parties. If, within six months from the date of the circulation of the communication, not less than one half of the States Parties reply favourably to the request, the Director-General shall present such proposal to the next session of the General Assembly for discussion and possible adoption.
2. Amendments shall be adopted by a two-thirds majority of States Parties present and voting.
3. Once adopted, amendments to this Convention shall be submitted for ratification, acceptance, approval or accession to the States Parties.
4. Amendments shall enter into force, but solely with respect to the States Parties that have ratified, accepted, approved or acceded to them, three months after the deposit of the instruments referred to in paragraph 3 of this Article by two-thirds of the States Parties. Thereafter, for each State Party that ratifies, accepts, approves or accedes to an amendment, the said amendment shall enter into force three months after the date of deposit by that State Party of its instrument of ratification, acceptance, approval or accession.
5. The procedure set out in paragraphs 3 and 4 shall not apply to amendments to Article 5 concerning the number of States Members of the Committee. These amendments shall enter into force at the time they are adopted.
6. A State which becomes a Party to this Convention after the entry into force of amendments in conformity with paragraph 4 of this Article shall, failing an expression of different intention, be considered: (a) as a Party to this Convention as so amended; and (b) as a Party to the unamended Convention in relation to any State Party not bound by the amendments.
Article 39 – Authoritative textsThis Convention has been drawn up in Arabic, Chinese, English, French, Russian and Spanish, the six texts being equally authoritative.
Article 40 – RegistrationIn conformity with Article 102 of the Charter of the United Nations, this Convention shall be registered with the Secretariat of the United Nations at the request of the Director-General of UNESCO.
DONE at Paris, this third day of November 2003,in two authentic copies bearing the signature of the President of the 32nd session of the General Conference and of the Director-General of UNESCO. These two copies shall be deposited in the archives of UNESCO. Certified true copies shall be delivered to all the States referred to in Articles 32 and 33, as well as to the United Nations.

  第35 条: 联邦制或非统一立宪制

  对实行联邦制或非统一立宪制的缔约国实行下述规定:

  (a) 在联邦或中央立法机构的法律管辖下实施本公约各项条款的国家的联邦或中央政府的义务与非联邦国家的缔约国的义务相同;

  (b) 在构成联邦,但无须按照联邦立宪制采取立法手段的各个国家、地区、省或州的法律管辖下实施本公约的各项条款时,联邦政府应将这些条款连同其关于通过这些条款的建议一并通知各个国家、地区、省或州的主管当局。

  第36 条: 退出

  1. 各缔约国均可宣布退出本公约。

  2. 退约应以书面退约书的形式通知教科文组织总干事。

  3. 退约在接到退约书十二个月之后生效。在退约生效日之前不得影响退约国承担的财政义务。

  第37 条: 保管人的职责

  教科文组织总干事作为本公约的保管人,应将第32 条和第33 条规定交存的所有批准书、接受书、赞同书或加入书和第36 条规定的退约书的情况通告本组织各会员国、第33 条提到的非本组织会员国的国家和联合国。

  第38 条: 修订

  1. 任何缔约国均可书面通知总干事,对本公约提出修订建议。总干事应将此通知转发给所有缔约国。如在通知发出之日起六个月之内,至少有一半的缔约国回复赞成此要求,总干事应将此建议提交下一届大会讨论,决定是否通过。

  2. 对本公约的修订须经出席并参加表决的缔约国三分之二多数票通过。

  3. 对本公约的修订一旦通过,应提交缔约国批准、接受、赞同或加入。

  4. 对于那些已批准、接受、赞同或加入修订的缔约国来说,本公约的修订在三分之二的缔约国交存本条第3 段所提及的文书之日起三个月之后生效。此后,对任何批准、接受、赞同或加入修订的缔约国来说,在其交存批准书、接受书、赞同书或加入书之日起三个月之后,本公约的修订即生效。

  5. 第3 和第4 段所确定的程序对有关委员会委员国数目的第5 条的修订不适用。此类修订一经通过即生效。

  6. 在修订依照本条第4 段的规定生效之后成为本公约缔约国的国家如无表示异议,应:

  (a) 被视为修订的本公约的缔约方;

  (b) 但在与不受这些修订约束的任何缔约国的关系中,仍被视为未经修订之公约的缔约方。

  第39 条: 有效文本

  本公约用英文、阿拉伯文、中文、西班牙文、法文和俄文拟定,六种文本具有同等效力。

  第40 条: 备案

  根据《联合国宪章》第102 条的规定,本公约应按教科文组织总干事的要求交联合国秘书处备案。
